1. Acceptance of Terms

By accessing and using AuPairly, you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our platform.

2. Service Description

AuPairly is a matching platform that connects families with au pairs in South Africa. We provide:

  • Profile creation for families and au pairs
  • Search and discovery tools for families
  • Messaging system for communication
  • Admin moderation for quality assurance

Important: AuPairly is a platform only. We do not employ au pairs, conduct background checks, or guarantee the quality of matches. Users are responsible for their own due diligence.

3. User Accounts

3.1 Account Creation

  • You must be 18 or older to create an account
  • You must provide accurate and complete information
  • You are responsible for maintaining account security
  • One account per person/family

3.2 Account Types

  • Au Pairs: Free access to create profiles and receive contacts from families
  • Families: Free to browse, subscription required to contact au pairs

4. Subscriptions & Payments

4.1 Family Subscriptions

Families must purchase a subscription to contact au pairs:

  • 7-Day Access: Contact unlimited au pairs for 7 days
  • 30-Day Access: Contact unlimited au pairs for 30 days

4.2 Payment Terms

  • All payments processed securely through PayFast
  • Subscriptions are non-refundable except as required by law
  • Prices are in South African Rand (ZAR)
  • We reserve the right to change pricing with notice

5. User Conduct

You agree NOT to:

  • Provide false or misleading information
  • Impersonate another person
  • Harass, abuse, or harm other users
  • Use the platform for illegal purposes
  • Spam or send unsolicited messages
  • Scrape or collect user data
  • Circumvent payment requirements

6. Profile Moderation

All au pair profiles are subject to admin review before being made visible. We reserve the right to approve, reject, or suspend profiles at our discretion. Reasons for rejection may include incomplete information, inappropriate content, or violations of these terms.

7. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We do not guarantee:

  • The quality, safety, or legality of profiles
  • The accuracy of user-provided information
  • That you will find a suitable match
  • Uninterrupted or error-free service

8. Limitation of Liability

To the maximum extent permitted by law, AuPairly shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform. Our total liability shall not exceed the amount you paid for subscriptions in the past 12 months.

9. Termination

We reserve the right to suspend or terminate your account if you violate these terms. You may delete your account at any time through your profile settings.

10. Governing Law

These terms are governed by the laws of South Africa. Any disputes shall be resolved in the courts of South Africa.
